2006 Harvest Festival Yard Sales

TITLE 3, BUSINESS LICENSE REGULATIONS
SECTION 1: Be it ordained by the Village Board of Trustees of the Village of Franklin Grove that the Code of the Village of Franklin Grove is hereby amended to add Title 3, Section 5 to the Code as follows:

YARD SALES
3-5-1: Yards Sales Defined
3-5-2: Permit Requirements

3-5-4: Penalties3-5-1: Yard Sales Defined: Included within the terms of this subsection, and heretofore referred to as "yard sales", is any display of merchandise for the purpose of exchanging it for legal tender or barter at a location not otherwise regularly used or specifically designated for the sale or exchange of merchandise. Events commonly known as "garage sales", tailgate sales", "flea markets', "rummage sales", "house sales", "moving sales", etc., shall be defined as yard sales under the provisions of this subsection.
3-5-2: Permit Requirements: Permits shall only be required for those yard sales being held on Thursday, Friday, Saturday and Sunday of Franklin Grove Summer Harvest Festival weekend. Each day of a yard sale shall constitute a separate permitted day for permit purposes.
3-5-3: Permit Fees: A permit fee of $5.00 (five dollars) for each day a yard sale is held must be paid before a permit is issued. A permit may be secured from the Village Clerk or his or her designates on or before the day the yard sale is to be held.
3-5-4: Penalties: Violators will be issued a $25.00 citation to be paid to the Village Clerk within ten (10) days. If fine is not paid within the ten (10) day period, charges will be brought for penalties according to general fines as provided in paragraph 1-4-1, General Penalty of the Village Code.
